GNA Dues and Fees Collection


Under the original GNA Covenants it was planned to collect the $93.00 Annual Assessments in four quarterly payments. When these Covenants were adopted it was thought that notices and bill paying would be done through the internet. However, it has become clear that this will not work. The reason is that we have e-mail addresses for fewer than ⅓ of the property owners and not all of them wish to make payments electronically.


Consequently, we decided to hand-deliver the first batch of invoices along with the petitions, e.g., the one to have the street lights deeded to the County (something that should have been done when the streets were deeded to them by VIA) so that the County will pay for the electricity they use, rather than the home owners paying twice for this service. Hand-delivery was done to save money - it costs about $300 to send a letter to each homeowner, assuming no cost for people's time to print the invoices, place them into envelopes, seal the envelopes, place a stamp on the envelopes, and then mail them. Doing this four times a year would cost $1,200.

Hand-delivering invoices and petitions to about 240 homes reached about half of them, primarily because volunteers could only do so much on the short notice we had that the GNA was now the official homeowners association. The other 60 homeowners must be sent invoices by mail since they do not live in those homes.

Through late July, 69 homeowners have paid dues. As requested in the invoice, some home owners paid for the second quarter, but some paid for two-quarters, and others for the remainder of the year.

The third quarter dues were due on 01 July and so the Board decided that, because people will be going door-to-door asking for signatures on petitions they would leave this note at every owner occupied house they visit.

People who have made a quarterly payment to GNA for Q2 have two choices: 1) pay $23.25 ASAP for Q3 and then another $23.25 on 01 October, or 2) make a single payment of $45.50 ASAP to cover their dues through the end of 2012. Some owners have already paid their dues through the end of 2012 and so do not need to pay any more until 2013. This note serves as the official notices of dues payments for the remainder of 2012.

Starting in 2013 we will adopt an Annual payment schedule, i.e., $93.00 will be due on 01 January. However, if anyone cannot make the full payment at that time they can contact the Treasurer and work out a no-interest installment payment plan.

Finally, some homeowners, presumably not among the approximately 85% of Las Maravillas Units II and III home owners who signed the GNA formation petition, have refused to pay their dues and stated that they were not members of the GNA. These homeowners, in particular, should be aware that, pursuant to the State of New Mexico, County of Valencia, Thirteenth Judicial District court order of May 18, 2012 the Good Neighbor Association is the legal representative for homeowners in Las Maravillas Units II and III. Specifically: "1. As of the date of entry of this Order, any and all rights, duties, and responsibilities as the Homeowners’ Association for Las Maravillas Units II and III shall transfer from VIA to Good Neighbor Association (“GNA”). Accordingly, the GNA “Covenants of Las Maravillas II and III” filed with the County Clerk of Valencia County on December 3, 2009 are valid and binding on the residents of Units II and Units III and the original VIA “Protective Covenants, Las Maravillas Subdivision Unit II, filed with the office of the County Clerk of Valencia County on June 1, 1993 and the “Protective Covenants for Paseo de Flores en Las Maravillas Unit III” filed with the office of the County Clerk of Valencia County on January 15, 1998 are without force and effect. The Good Neighbor Association is the sole legal homeowners association of Las Maravillas Units II and III, and GNA assumes and shall be responsible for and shall perform, discharge and fulfill any and all duties and responsibilities required of it as the acting homeowners’ association."
